Traffic Deferral

To be eligible for the traffic deferral program, you must have a clean driving record (no convictions in the past five years) and you must certify that you have not participated in a similar traffic deferral program with the past five years. The traffic deferral program is not offered on cell phone violations or to anyone who has a Commercial Driver’s License. The traffic deferral program generally does not reduce your overall cost because you will be required to pay a fine, and in addition to the fine imposed, you will pay a class fee to attend a traffic class. The benefit of the deferral program is that successful completion results in a dismissal of the citation thereby avoiding a conviction on your driving record.

If you qualify and participate in the traffic deferral program, you will be required to pay the fine and attend a class within sixty (60) days of your initial court appearance date. You will also be required to enter a “no contest” plea to the citation as part of the deferral. During the time you are on deferral, you cannot receive any new citations. Receiving a new citation during your deferral period could void the agreement which would result in entry of your “no contest” plea and a conviction which will appear on your driving record. However, if you attend the class, pay the fine and receive no new citations within the sixty (60) days, the citation will be dismissed and will not appear on your driving record.
